Trusts & Estates

  • Changing federal and state estate tax laws make preserving your estate and protecting your family a constant challenge. The Trusts & Estates Practice Group at Hill Wallack LLP is sensitive to this simple fact and works to provide its clients with shelter against potential conflict and unnecessary expense.

Our Group is fully experienced in all aspects of trust and estate matters. We apply our experience practically and efficiently to assist clients in the transfer of their property and to resolve disputes and avoid the dissipation of wealth. Our services range from the preparation of simple wills, to the creation of complex trusts, to arranging for tax-exempt charitable gifts. We administer estates from the probate of the will, through the collection of the decedent's assets, payment of liabilities, preparation and filing of the estate tax returns, resolution of tax controversies, and the distribution of the property to the beneficiaries. We also advise fiduciaries and other trustees with respect to the administration of trusts and their distribution upon termination.

We are fully prepared to assist clients in the amicable resolution of disputes over the disposition of estate and family assets. When necessary, we are also fully prepared to engage in litigation on your behalf. When the situation requires, our Group will apply a cross-disciplinary approach -- working with other attorneys in the firm -- to assist and advise clients in the structuring of a business enterprise, the acquisition or sale of assets, or the resolution of matrimonial and other related family matters.

While broad labels may be applied to the many of issues addressed by trust and estate law, each client inevitably presents a combination of facts and circumstances which are unique to that particular individual. The Trusts & Estates Practice Group at Hill Wallack LLP believes that our clients are best served by the efficient application of our knowledge and experience, targeting solutions which are appropriate for that individual and with special attention to the preservation of his or her wealth.

Finally we can help you with the legal problems associated with aging, including medicaid planning, guardianship and related issues.
